Welcome to Amivio. These Terms of Service ("Terms") govern your use of the Amivio mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using Amivio, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Membership Agreement (if applicable). These Terms constitute a legally binding agreement between you and Amivio.

2. Eligibility

You must be at least 18 years old to use Amivio. By using the App, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will use the App in compliance with these Terms and all applicable laws
• All information you provide is accurate and truthful

3. License to Use

3.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device solely for your personal, non-commercial use.

3.2 Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality
• Use the App to transmit viruses, malware, or harmful code
• Sell, rent, lease, sublicense, or transfer your rights to the App

4. User Content

4.1 Your Content

You retain all rights to the content you create and store in the App, including:

• Dive log entries
• Photos and videos
• Equipment information
• Certification records
• Personal notes and comments

4.2 Content Storage

Your content is primarily stored locally on your device. Pro members who enable cloud backup grant us permission to store and backup their media files on our servers solely for the purpose of providing the cloud backup service.

4.3 Content Responsibility

You are solely responsible for your content. You agree that your content will not:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Contain offensive, defamatory, or inappropriate material
• Contain viruses or malicious code

5. Purchases and Payments

5.1 In-App Purchases

Amivio offers in-app purchases including:

• Coin packages (consumable purchases)
• Pro membership subscriptions (auto-renewable subscriptions)

5.2 Payment Processing

All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's payment terms and conditions. We do not have access to your payment information.

5.3 Pricing

Prices for in-app purchases are displayed in the App and may vary by region. Prices are subject to change without notice, but changes will not affect purchases already made.

5.4 Refunds

All purchases are final and non-refundable except as required by law or as determined by Apple's refund policy. To request a refund, please contact Apple Support directly.

6. Subscriptions

For detailed information about Pro membership subscriptions, including billing cycles, automatic renewal, and cancellation procedures, please refer to our Membership Agreement.

7. Coins

7.1 Coin Purchases

Coins are virtual currency used within the App to access certain features and content. Coins can be purchased through in-app purchases.

7.2 Coin Usage

Coins can be used for:

• AI marine life identification (for non-Pro members)
• Unlocking special content
• Purchasing themes and customizations
• Expanding cloud storage (for non-Pro members)

7.3 Coin Limitations

Coins:

• Have no cash value and cannot be exchanged for real currency
• Cannot be transferred to other users
• Do not expire
• Are non-refundable once purchased
• Will be forfeited if your account is terminated

8. Intellectual Property

8.1 Our Rights

The App and all its content, features, and functionality (including but not limited to software, text, graphics, logos, icons, images, and design) are owned by Amivio and are protected by international copyright, trademark, and other intellectual property laws.

8.2 Trademarks

"Amivio" and related logos are trademarks of Amivio. You may not use these trademarks without our prior written permission.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk.

13. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue any part of the App at any time
• Update the App to add new features or fix bugs
• Change pricing for in-app purchases
• Limit or restrict access to certain features

We will make reasonable efforts to notify you of significant changes.

14. Termination

14.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. You may delete your account through the App settings.

14.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent activity
• Use the App in a way that could harm us or other users
• Violate applicable laws

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You must uninstall the App from your device
• Your account data will be deleted according to our Privacy Policy
• Any unused coins will be forfeited
• Active subscriptions will continue until the end of the current billing period

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Amivio operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

• Good faith negotiations between the parties
• If negotiations fail, binding arbitration in accordance with applicable arbitration rules

17. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by:

• Posting the new Terms in the App
• Updating the "Last Updated" date
• Sending a notification through the App

Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Membership Agreement, constitute the entire agreement between you and Amivio regarding the use of the App.
